Terms of Service
Effective Date: April 1st, 2026
These Terms of Service (“Terms”) govern your access to and use of www.mysilue.com (the “Website”), including any inquiries, purchases, accounts, products, white label services, distribution services, and related business services offered through the Website.
The Website and related services are operated by Silue™ (“Silue™,” “we,” “us,” or “our”).
By accessing the Website, submitting an inquiry, creating an account, approving an order, or purchasing products from Silue™, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Website or place an order.
1. Business-to-Business Services
Silue™ provides garments and related services to approved professional and commercial partners, including:
- surgeons and medical practices
- clinics and med spas
- recovery centers
- distributors
- retailers
- healthcare-related businesses
- other approved commercial partners
Silue™ offers different commercial programs depending on the nature of the business relationship, including white label programs and authorized distribution programs.
White Label Customers
Approved white label customers may purchase products customized with their own branding, labeling, or packaging, subject to the applicable minimum order quantities, customization requirements, quotations, and commercial terms.
Authorized Distributors
Businesses approved as Silue™ distributors must market, promote, and distribute products exclusively under the Silue™ brand.
Authorized Silue™ distributors are not eligible for white label or private label services during their distribution relationship with Silue™.
Each distributor must identify the country, region, state, city, or other geographic territory in which it intends to operate. The proposed territory must be reviewed and approved in writing by Silue™.
A distributor may not actively market products, appoint resellers, establish distribution channels, or represent itself as an authorized Silue™ distributor outside its approved territory without prior written authorization from Silue™.
The appointment of a distributor, its approved territory, commercial conditions, and any applicable exclusivity or performance requirements must be established in a separate written distribution agreement approved by Silue™.
Unless expressly stated in a signed distribution agreement, appointment as a Silue™ distributor does not grant exclusivity within any territory.
When using the Website or placing an order on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Silue™ reserves the right to decline an inquiry, account, partnership, distribution request, or order at its discretion.
2. Eligibility and Account Information
You must be at least 18 years old and legally capable of entering into a binding agreement to use our services.
When creating an account or submitting information, you agree to provide accurate, complete, and current information.
You are responsible for:
- maintaining the confidentiality of your account credentials
- restricting unauthorized access to your account
- reviewing all order information submitted through your account
- notifying Silue™ promptly of suspected unauthorized activity
You are responsible for all activity conducted through your account unless prohibited by applicable law.
3. Website Use
You may use the Website only for lawful business purposes.
You may not:
- use the Website for fraudulent, unlawful, or misleading activity
- interfere with the security or proper operation of the Website
- attempt to access restricted systems, accounts, or data
- introduce malicious software, automated scraping tools, or harmful code
- copy, reproduce, or commercially exploit Website content without authorization
- misrepresent your identity, business, professional credentials, or purchasing authority
- use Silue™ trademarks, photographs, product information, or materials without permission
Silue™ may suspend or terminate access to the Website when it reasonably believes these Terms have been violated.
4. Product Information
Silue™ makes reasonable efforts to display product descriptions, colors, measurements, specifications, and images accurately.
However:
- colors may vary depending on screens, production materials, and manufacturing batches
- measurements may be subject to reasonable production tolerances
- product packaging or components may change when improvements are introduced
- photographs are provided for general reference and may not represent every customization option
Product information may be corrected or updated without prior notice.
If a product description, price, or specification contains an error, Silue™ may correct the error, cancel the affected order, or contact the customer for approval before continuing production.
5. Professional and Medical Disclaimer
Silue™ garments are designed to support comfort, compression, recovery, and professional garment programs.
Information provided on the Website is for general commercial and educational purposes only. It is not intended to replace:
- medical advice
- diagnosis
- treatment
- post-operative instructions
- professional sizing assessments
- recommendations from a licensed healthcare provider
Healthcare professionals and business partners are responsible for determining whether a particular garment is appropriate for an individual patient or customer.
Silue™ does not guarantee any specific medical, surgical, therapeutic, or recovery outcome.
6. Orders and Acceptance
Submitting an order does not automatically create an obligation for Silue™ to manufacture or supply the requested products.
An order becomes confirmed when:
- the products, quantities, sizes, colors, pricing, and customization details have been approved;
- Silue™ has accepted the order; and
- the required initial payment has been successfully received.
Silue™ may request additional information before accepting an order.
Silue™ may reject or cancel an order because of:
- pricing or product-information errors
- unavailable materials
- production limitations
- suspected fraud
- regulatory or shipping restrictions
- failure to meet minimum-order requirements
- incomplete customization information
- nonpayment
If Silue™ cancels an order before production begins, amounts paid for the cancelled products will be refunded.
7. Minimum Order Quantities
Certain products are subject to minimum order quantities.
Unless otherwise stated on the applicable product page, quotation, invoice, or order confirmation, the standard minimum order quantity for many products is twelve units per size and color.
Minimum order quantities may vary according to:
- product style
- size
- color
- fabric
- labeling requirements
- packaging
- customization
- delivery destination
The minimum order quantity shown in the approved quotation or order confirmation will control.
8. Pricing
The Website and the prices displayed on it are intended exclusively for customers with a shipping address within the United States.
Orders Shipped Within the United States
For orders delivered to an address within the United States, the prices displayed on the Website include:
- applicable import duties
- bank fees
- payment-processing fees
Unless expressly stated otherwise, the displayed prices do not include:
- shipping charges
- applicable sales, use, or similar taxes
- insurance
- custom labels
- custom packaging
- product development or special customization costs
Shipping charges will be calculated separately based on the order, package dimensions, weight, shipping method, and delivery destination.
Orders Shipped Outside the United States
Prices displayed on the Website do not apply to orders shipped outside the United States.
International customers must contact Silue™ to receive the applicable price list and commercial terms for their country or delivery destination:

International pricing may vary depending on the destination country, import duties, taxes, customs requirements, shipping costs, payment-processing costs, and other applicable expenses.
Any duties, taxes, shipping charges, customs brokerage expenses, bank fees, payment-processing fees, or other costs applicable to an international order will be specified in the corresponding quotation, invoice, commercial agreement, or order confirmation.
Prices may change without prior notice. However, a price change will not affect an order that has already been accepted and confirmed unless the customer approves a modification.
If a quotation includes an expiration date, the quoted pricing will remain valid only through that date.
9. Payment Terms
Unless different payment terms are stated in an approved quotation, invoice, commercial agreement, or order confirmation, a 50% initial payment is required at the time the order is placed through the Website.
Production will not begin until the initial payment has been successfully received and confirmed.
The remaining 50% balance, together with all applicable shipping fees, must be paid upon dispatch of the order.
Silue™ will issue the corresponding invoice or payment request when the order is dispatched.
Failure to pay an outstanding balance may result in the suspension of the customer’s account, the delay or cancellation of future orders, and the initiation of reasonable collection procedures.
The customer is responsible for any reasonable collection costs resulting from overdue balances, to the extent permitted by applicable law.
Payments may be processed through third-party payment providers. The use of those payment services may also be subject to the applicable provider’s separate terms and privacy policies.
10. Made-to-Order Production
Silue™ operates primarily through a made-to-order production model and does not maintain inventory for all products, sizes, colors, or customization options.
Production begins after:
- the order has been approved
- all required information has been provided
- customization details have been confirmed
- the initial payment has been received
Manufacturing typically requires approximately three to four weeks. This timeframe is an estimate and not a guaranteed completion or delivery date.
Production time may vary because of:
- order volume
- material availability
- customization requirements
- labeling or packaging development
- production capacity
- quality-control reviews
- holidays
- transportation disruptions
- events outside the reasonable control of Silue™
Silue™ will make reasonable efforts to communicate material production delays.
11. Order Changes and Cancellations
Customers must carefully review all styles, quantities, sizes, colors, artwork, labels, packaging, and specifications before approving an order.
Changes requested before production begins may be accepted at the discretion of Silue™.
Once production has begun:
- the order may not be cancelled without written approval from Silue™
- changes may not be possible
- additional charges may apply
- production timelines may be extended
- payments may become non-refundable to the extent that materials, labor, customization, or production costs have already been incurred
Any approved modification must be documented in writing.
12. White Label and Customization Services
White label, private label, packaging, branding, and customization services are available only to customers approved under the Silue™ white label program.
These services are not available to authorized Silue™ distributors.
White label and customization services may require the customer to provide:
- logos
- trademarks
- artwork
- label content
- business information
- care instructions
- packaging specifications
- regulatory information
- other brand materials
By providing these materials, the customer represents and warrants that:
- it owns the materials or has authorization to use them
- their use does not infringe third-party rights
- they are accurate and legally compliant
- they do not contain unlawful or misleading claims
The customer is responsible for reviewing and approving all artwork, labels, packaging, spelling, dimensions, colors, and specifications before production.
Silue™ is not responsible for errors contained in materials approved by the customer.
Additional charges may apply for revisions, samples, custom development, labels, packaging, setup, or low-volume customization.
13. Intellectual Property
All Website content owned or licensed by Silue™ is protected by applicable intellectual-property laws.
This includes:
- the Silue™ name and trademarks
- logos
- product photographs
- graphics
- Website design
- product descriptions
- educational materials
- videos
- downloadable materials
- text and written content
- proprietary garment designs and specifications
Access to the Website does not grant ownership or a license to use Silue™ intellectual property except for ordinary Website use.
You may not reproduce, distribute, modify, publish, sell, license, or create derivative works from Silue™ content without prior written permission.
Customer-owned trademarks and approved white label branding remain the property of the customer or their respective owners.
14. Shipping
Orders are generally shipped from Colombia after production and quality-control processes have been completed.
Shipping times depend on the destination, carrier, customs process, and selected shipping method. Estimated transit time is generally between three and ten business days, but delivery dates are not guaranteed.
The customer is responsible for providing a complete and accurate shipping address.
Silue™ is not responsible for delays caused by:
- shipping carriers
- customs authorities
- incorrect or incomplete addresses
- import inspections
- weather conditions
- strikes
- port congestion
- governmental restrictions
- recipient unavailability
- events outside the reasonable control of Silue™
Shipping charges are calculated separately and must be paid together with the remaining 50% order balance upon dispatch.
15. Customs, Duties, and Import Compliance
For orders shipped to an address within the United States, applicable import duties are included in the product pricing unless expressly stated otherwise.
For orders shipped outside the United States, the recipient or importer of record may be responsible for:
- customs duties
- import taxes
- value-added taxes
- brokerage charges
- local permits
- product registrations
- import requirements
- customs documentation required in the destination country
The specific responsibilities and costs applicable to an international order will be established in the corresponding quotation, invoice, commercial agreement, or order confirmation.
International customers are responsible for confirming that the products may be legally imported, marketed, distributed, and sold in the destination market.
Silue™ is not responsible for products delayed, rejected, detained, or confiscated because the customer failed to comply with local import or regulatory requirements.
16. Risk of Loss
Risk of loss or damage transfers according to the shipping terms stated in the applicable quotation, invoice, order confirmation, or commercial agreement.
When no separate shipping term is stated, risk of loss transfers to the customer when the order is delivered to the shipping carrier, except where applicable law requires otherwise.
Silue™ will reasonably assist the customer with carrier claims when appropriate but cannot guarantee that a carrier claim will be approved.
17. Returns and Manufacturing Defects
Because Silue™ products are made according to customer-selected styles, sizes, colors, quantities, branding, and specifications, general returns and exchanges are not accepted.
Returns are not accepted because of:
- incorrect sizes ordered by the customer
- dissatisfaction with fit or personal preference
- over-ordering
- changes in business needs
- normal production variation
- approved customization
- improper care or storage
- misuse
- normal wear and tear
- third-party alterations
Claims are accepted only for qualifying manufacturing defects.
A defect claim must be submitted to sales@wearesilue.com within 72 hours after delivery and should include:
- order number
- product reference or style
- quantity affected
- description of the issue
- clear photographs of the product
- photographs of the packaging when transit damage is involved
Silue™ will review the claim and determine whether the issue qualifies as a manufacturing defect.
For an approved claim, Silue™ may, at its discretion:
- replace the affected product
- issue a credit
- repair the product when appropriate
- provide another reasonable resolution
Additional terms may be described in the applicable Returns and Defects Policy, which is incorporated into these Terms by reference.
18. Resale and Customer Responsibilities
Business partners are responsible for how products are marketed, distributed, recommended, fitted, and resold to their patients, clients, retailers, or customers.
The customer agrees not to:
- make unsupported medical claims
- misrepresent product features
- remove required labels or warnings
- market products in violation of applicable laws
- represent itself as an employee, agent, or legal representative of Silue™ without authorization
- alter products in a manner that may create a safety or quality concern
- sell or actively distribute Silue™ products outside an approved distribution territory
- Any relationship between the customer and its patients, clients, resellers, or end users is the customer’s responsibility.
19. Third-Party Services and Links
The Website may include services, content, applications, or links provided by third parties, including:
- payment processors
- shipping providers
- analytics providers
- social-media platforms
- communication services
- Shopify and related applications
Silue™ does not control and is not responsible for the availability, security, content, terms, or privacy practices of third-party services.
Use of a third-party service is subject to that provider’s own terms and policies.
20. Privacy
Your use of the Website is also subject to the Silue™ Privacy Policy.
By using the Website, you acknowledge that personal information may be collected, processed, stored, and shared as described in the Privacy Policy.
21. Disclaimer of Warranties
To the maximum extent permitted by law, the Website, its content, products, and related services are provided on an “as is” and “as available” basis.
Silue™ does not warrant that:
- the Website will operate without interruption
- the Website will be free from errors or security vulnerabilities
- every product image will precisely match the finished product
- estimated production or shipping dates will always be met
- products will produce a specific medical or commercial outcome
Nothing in these Terms excludes warranties that cannot legally be excluded.
Product-related remedies are limited to those expressly provided in these Terms, an applicable written warranty, the Returns and Defects Policy, or applicable law.
22. Limitation of Liability
To the maximum extent permitted by applicable law, Silue™ will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including:
- loss of profits
- loss of revenue
- loss of business opportunity
- loss of goodwill
- loss of data
- business interruption
- customer or patient claims
- delays caused by third parties
To the maximum extent permitted by law, the total liability of Silue™ arising from a particular order will not exceed the amount paid to Silue™ for the products directly giving rise to the claim.
These limitations do not apply where liability cannot legally be limited or excluded.
23. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Silue™ and its owners, officers, employees, contractors, manufacturers, and service providers from claims, damages, liabilities, losses, and reasonable expenses arising from:
- your violation of these Terms
- your misuse of the Website or products
- materials, branding, trademarks, or instructions supplied by you
- your marketing, distribution, recommendation, fitting, or resale of products
- unsupported medical or commercial claims made by you
- your violation of applicable law or third-party rights
- disputes between you and your customers, patients, distributors, retailers, or end users
- your sale or distribution of Silue™ products outside an approved territory
This obligation does not apply to the extent a claim results directly from the proven gross negligence or intentional misconduct of Silue™.
24. Force Majeure
Silue™ will not be responsible for a delay or failure caused by events outside its reasonable control, including:
- natural disasters
- epidemics or public-health emergencies
- fires or floods
- war or civil unrest
- labor disputes
- transportation interruptions
- customs delays
- governmental actions
- import or export restrictions
- material shortages
- utility failures
- telecommunications outages
- carrier delays
When reasonably possible, Silue™ will communicate significant delays and resume performance after the event is resolved.
25. Suspension and Termination
Silue™ may suspend or terminate access to the Website, services, distribution program, or customer account when:
- these Terms are violated
- payment obligations are not fulfilled
- fraud or unlawful conduct is suspected
- a distributor operates outside its approved territory
- a distributor attempts to offer white label or private label products
- continued service may create legal, regulatory, security, or reputational risk
Termination does not eliminate payment obligations or other liabilities arising before termination.
Sections that by their nature should survive termination will remain effective, including provisions related to payment, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.
26. Governing Law
These Terms and any dispute arising from the Website, products, orders, or services will be governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.
The parties agree that disputes will be brought before a court of competent jurisdiction located in the State of Florida unless applicable law requires another forum.
Before initiating formal legal proceedings, the parties agree to make a reasonable good-faith effort to resolve the dispute through direct written communication.
27. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will continue in effect.
28. No Waiver
The failure of Silue™ to enforce any provision of these Terms does not waive its right to enforce that provision or any other provision in the future.
29. Entire Agreement
These Terms, together with the Privacy Policy, Returns and Defects Policy, Shipping and Production Policy, applicable quotations, invoices, order confirmations, and written commercial agreements, constitute the agreement between the customer and Silue™ regarding the applicable Website use or transaction.
When a signed commercial agreement expressly conflicts with these Terms, the signed commercial agreement will control for that transaction.
30. Changes to These Terms
Silue™ may update these Terms from time to time to reflect changes in:
- business practices
- products or services
- Website functionality
- legal requirements
- commercial policies
Updated Terms will be published on this page with a revised effective date.
Changes will not retroactively modify confirmed orders unless required by law or agreed to in writing.
Continued use of the Website after updated Terms become effective constitutes acceptance of the revised Terms.
